Security of Payment: Everything You Need to Know

In South Australia, a statutory right to progress payments for construction and related services work is provided for by the Building and Construction Industry Security of Payment Act 2009 (SA) (“The Act”).
The Act is centred on the right to Progress Payments which is implemented by a procedure to enforce those Progress Payments. Adjudication is the dispute resolution process built into the Act which is a practical method of determining, on an interim basis, the liability of a Respondent to pay a Claimant a Progress Payment.
