HAVE YOUR SAY on the new DESIGN AND BUILDING PRACTITIONERS ACT regulations

We invite your feedback on the draft Design and Building Practitioners Regulation 2020.

The regulation is being made under the Design and Building Practitioners Act 2020, which was passed in June 2020. The regulation is scheduled to come into effect on 1 July 2021.

Under the registration scheme, the regulation will establish, each step of construction must be documented. Practitioners will be required to design and build in accordance with the Building Code of Australia.

This is part of the new “Construct NSW” reform strategy running over two years to raise standards of Class 2 buildings, particularly multi-storey residential apartments.

The regulation would introduce:

  • A new registration scheme for design and building practitioners and for professional engineers
  • New obligations for design and building practitioners to declare their work is compliant with the Building Code of Australia
  • A new Code of Practice for design and building practitioners and professional engineers that sets minimum professional and ethical standards
  • New investigative and enforcement powers to ensure compliance
